제가 조금전에 직접 고객님께 전화드려 아래 문의사항에 대해 답변을 드렸는데요. 저희 캐나다팀에서 보내드린 이메일 우선 확인하시고 이후 상세 상담 도와드리겠습니다.

너무나 안타깝지만 결론적으로, 다시금 Family sponsorship-outside processing 진행은 불가합니다. Sponsor 영주권 신청시, 최종적으로 캐나다 이민비자 발급 전 또는 캐나다 랜딩할 때라도 반드시 Change of family member status는 꼭 이민국에 보고해야 하는 절차입니다. 이혼,출산,결혼 등으로 인한 신상 변화는 반드시 꼼꼼히 체크해서 이민 신청 적격여부에 문제 되지 않도록 컨설팅 및 조치해야 하는 것이 전문적인 이민회사가 당연히 해야할 일이죠. 캐나다 현지의 그 2개의 이주공사 업체 모두 제대로 된 법률적 지식이나 케이스 경험에 대한 무지로 인해, 고객님께 정확한 안내를 드리지 못하여, 결국은 너무나 어이없고 안타까운 결과를 초래하게 만든 것으로 밖에 안 보입니다.

저희가 조언드린 대로, 아이 출산 이후 Humanitarian and compassionate grounds ( H&C ) 케이스로 접수해 보거나, 고객님 스스로의 자격으로 캐나다 이민 신청을 하시는 방법 뿐입니다.

많은 분들이 이민법인대양에 대한 긍정적인 이야기를 해주어 실낙같은 희망을 가지고 문의드립니다

1) 저희는 2014년 4월 6일에 결혼하였고 4월12일에 캐나다에 입국하였습니다.
2) 배우자는 2014년 5월2일에 싱글로 영주권을 받았습니다.


이때 당시 도와주던 이주공사에서 중간에 결혼여부를 보고 해야함을 알려주지 않았고, 영주권을 바로 받기 위해서는 싱글로 받아야 한다고 해서 싱글로 국경에서 영주권을 받았습니다. 이 때 이주공사측에서는 이민법이 계속해서 바뀌는 과정이기때문에 배우자의 영주권 부터 받아두는 것이 좋다고 하였습니다.


당시 캐나다에 도착하자마자 배우자의 회사에서 경영악화로 배우자를 해고한 상태여서 이성적으로 판단하기도 힘들고 이에 대한 정보를 따로 알아볼수 있는 상황이 되지 않았습니다. 그렇게 영주권을 받고 취업을 위해 캘거리로 이사하였습니다.


3) 취업후 캘거리에 있는 이주공사에서 배우자 영주권신청을 진행하였습니다.
당시 우리는 이 문제가 심각함을 몰랐고 캘거리소재의 이주공사에서는 이 문제에 대해서 별 다른 언급없이 배우자 영주권신청이 인사이드로 들어갔습니다


4) 2016년 4월13일 " 배우자가 영주권 랜딩시 가족을 신고하지 않았다" 하여 배우자영주권 신청이 거절되었습니다.
이 부분에 대해서 어떻게 대처할지도 무엇을 할지도 모르겠고 현 이주공사에서는 EE 진행을 이야기 하고 있습니다. 현재 아웃사이드로 재신청을 해야할지 다른 방법이 있는지 어찌해야할지 잘 모르겠습니다.

Dear --------- Moon:

This refers to the Application for Permanent Residence you made under the Spouse or Common-Law
Partner in Canada Class.
I have determined that you do not meet the requirements for immigration to Canada.
Subsection 12(1) of the Immigration and Refugee Protection Act states that a foreign national may be
selected as a member of the family class on the basis of their relationship as the spouse, commonlaw
partner, child, parent or other prescribed family member of a Canadian citizen or permanent
resident.
Subsection 125(1)(d) of the Immigration and Refugee Protection Regulations states that a foreign
national shall not be considered a member of the spouse or common-law partner in Canada class by
virtue of their relationship to the sponsor if the sponsor previously made an application for permanent
residence and became a permanent resident and, at the time of that application, the foreign national
was a non-accompanying family member of the sponsor and was not examined.
Your sponsor failed to declare you and have you examined for the purposes of immigration, within
his/her application for permanent residence. On Sept 19, 2013 your husband applied for Permanent
Residence as a single applicant with no dependents. On April 1, 2014 you were married. He failed to
notify Citizenship and Immigration of his change in Family status. On May 2, 2014 he became a
Permanent Resident at a port of entry into Canada. He failed to declare you as his spouse during the
processing of his application and at his landing interview. As he failed to declare you as his
dependent, Citizenship and Immigration was not giving the opportunity to have you undergo an
examination. As a result, I have determined that you are not a member of the spouse or common-law
partner in Canada class.
Subsections 72(1)(c) and 72(1)(d) of the Regulations indicates that a foreign national in Canada
becomes a permanent resident if, following an examination, it is established that they are a member
of that class and they meet the selection criteria and other requirements applicable to that class.
For the reasons set out above, I am not satisfied that you are not an excluded member of the spouse
or common-law partner in Canada class. I am therefore refusing your application for permanent
residence.
If the Right of Permanent Residence fee was paid, it will be refunded within six to eight weeks to the
payee listed on the proof of payment you submitted with your application. If the fee was paid by credit
card, it will be credited back to the credit card account. Otherwise, a cheque will be mailed to the payee’s address in approximately six weeks to eight weeks.
Should you wish to reapply, you will be required to submit a new application and pay a new processing fee. Any new application will be assessed according to the Immigration and Refugee Protection Act in force at the time that the new application is filed.
